Purpose of flowprofiler® products and services
flowprofiler® Pty Ltd provides workplace psychometric assessments, behavioural profiles, reports, training, coaching and organisational-development resources.
Our products and services are designed to support:
- personal and professional development;
- workplace learning and reflection;
- leadership and team development;
- coaching and facilitated discussion;
- organisational development; and
- appropriately informed workplace decision-making.
They are intended to support, rather than replace, professional judgement, organisational due diligence and consideration of other relevant information.
Workplace assessment, not clinical assessment
flowprofiler® assessments are workplace psychometric and behavioural-development tools.
They are not clinical psychological assessments and do not constitute:
- medical advice, diagnosis or treatment;
- clinical psychological diagnosis, treatment or therapy;
- psychiatric advice or treatment;
- counselling or crisis support;
- occupational-health assessment;
- assessment of medical or psychological fitness for work;
- legal or financial advice; or
- another regulated health or professional service unless expressly stated in a separate written agreement.
A flowprofiler® assessment must not be used to diagnose a mental-health condition, neurodevelopmental condition, personality disorder, medical condition or disability.
It must not be treated as evidence that a person is medically or psychologically fit or unfit for a role or activity.
Anyone requiring medical, clinical, psychological, legal, financial, occupational-health or other specialist advice should consult an appropriately qualified professional.
flowprofiler® services are not an emergency, counselling or crisis-response service.
Nature and limitations of assessment results
flowprofiler® assessment results are generated from information provided through the applicable assessment process.
Depending on the assessment, this may include:
answers provided by the participant;
ratings or comments provided by authorised raters;
information supplied by a commissioning organisation;
applicable scoring rules;
comparison or norm groups; and
the circumstances in which the assessment was completed.
Assessment results represent an interpretation of the information available at the time of assessment.
They are not:
a complete description of an individual;
a statement of permanent or objective fact;
a clinical diagnosis;
a guarantee of future conduct or performance;
a prediction that a person will respond in the same way in every situation;
proof that a person is suitable or unsuitable for a role; or
proof of medical or psychological fitness.
Behaviour may vary according to context, experience, motivation, health, environment, relationships, role expectations and other circumstances.
Results may be affected by inaccurate, incomplete, rushed, misunderstood or intentionally misleading responses.
Rater feedback and 360-degree assessments
Ratings and comments provided through a 360-degree or other multi-rater assessment reflect the perceptions and experiences of the people who provided them at the time.
They should be interpreted as patterns of feedback and not automatically treated as:
independently verified facts;
findings of misconduct;
clinical or professional opinions;
complete representations of an event or relationship; or
definitive statements about the participant.
The commissioning organisation remains responsible for investigating any factual, employment, grievance, conduct or safety concern raised through an assessment.
Appropriate interpretation and use
Assessment reports should be interpreted:
for their stated and authorised purpose;
in accordance with applicable manuals, guidance and training;
by an appropriately authorised or qualified person where required;
in the context of the participant’s role and circumstances; and
alongside other relevant and reliable information.
No assessment removes the need for professional judgement, appropriate due diligence or consideration of supplementary evidence.
Employment and other significant decisions
A flowprofiler® assessment or report should not ordinarily be used as the sole basis for:
recruitment or selection;
promotion or succession;
remuneration;
performance management;
disciplinary action;
dismissal;
access to employment or development;
assessment of medical or psychological fitness; or
another decision that may have a legal or similarly significant effect on an individual.
Meaningful human judgement must be applied to any workplace decision informed by a flowprofiler® assessment.
The person or organisation making the decision remains responsible for:
determining whether the assessment is appropriate for the intended purpose;
considering relevant supplementary evidence;
complying with employment, discrimination, privacy and other applicable laws;
identifying and addressing possible errors, bias or inappropriate conclusions;
providing any opportunity for the affected individual to respond or seek review where required; and
making and documenting the final decision.
flowprofiler® Pty Ltd does not make the commissioning organisation’s final employment or organisational decisions.
Client, administrator and practitioner responsibilities
Clients, administrators, trainers, coaches, facilitators and other authorised users are responsible for:
using flowprofiler® products only for their intended and authorised purposes;
completing any required accreditation or training;
following applicable manuals, guidance and professional standards;
working within their competence and authority;
protecting the confidentiality of assessment information;
providing participants with appropriate information about the assessment;
obtaining any required permission or lawful authority;
limiting access to authorised recipients;
avoiding unauthorised alteration or selective presentation of results;
avoiding discriminatory or otherwise unlawful use; and
referring matters outside their competence to an appropriately qualified professional.
flowprofiler® Pty Ltd is not responsible for independent advice, representations, interpretations or services provided by a client, trainer, coach, consultant or other third party where those activities fall outside the authorised content and intended use of the relevant flowprofiler® product or service.
Training, coaching and development activities
Training materials, exercises, coaching questions and development suggestions provide general workplace-development information.
Their relevance and suitability depend on the individual, organisation, purpose and circumstances.
Participants remain responsible for deciding whether and how to apply a development activity.
A participant should not undertake an activity where doing so would be:
unsafe;
unlawful;
outside their authority or competence;
contrary to organisational requirements; or
contrary to advice from an appropriately qualified professional.
A participant should stop an activity and seek appropriate assistance where it causes significant distress, raises a concern about physical or psychological health, or may create a risk to the participant or another person.
Children and young people
flowprofiler® workplace assessments and services are intended for adults aged 18 years or over unless flowprofiler® Pty Ltd has expressly approved another arrangement in writing.
A client must not invite a person under 18 to complete an assessment without:
first informing flowprofiler® Pty Ltd;
establishing an appropriate and lawful purpose;
implementing age-appropriate information and safeguards;
obtaining any required consent or authority; and
complying with applicable child-protection, privacy and employment requirements.
No guarantee of outcomes
Assessment insights, training, coaching and development activities may support learning and behaviour change, but outcomes depend on many factors outside the control of flowprofiler® Pty Ltd.
flowprofiler® Pty Ltd does not guarantee:
a particular assessment result;
behavioural or attitudinal change;
improved individual or organisational performance;
employment, promotion or career advancement;
successful implementation of a development action;
achievement of a particular commercial or financial result; or
elimination of workplace, leadership or people-related risk.
Clients and participants remain responsible for their decisions, actions, implementation and outcomes.
Unauthorised use
Subject to applicable law, flowprofiler® Pty Ltd is not responsible for loss or harm resulting from:
use of a product outside its intended or authorised purpose;
use by an unauthorised or insufficiently trained person;
reliance on an altered, incomplete or out-of-date report;
inaccurate or incomplete information supplied by a participant, rater, client or user;
unauthorised reproduction, adaptation or modification of assessment content;
interpretation inconsistent with applicable guidance;
disclosure to an unauthorised recipient;
reliance on an assessment without appropriate contextual or supplementary information;
uploading assessment content, participant information or reports to an unauthorised artificial intelligence system;
decisions made independently by a client, employer, practitioner or other third party; or
use that breaches the applicable Terms of Use, client agreement or product conditions,
except to the extent that responsibility cannot lawfully be excluded or limited.
Intellectual property
The flowprofiler® platform, assessments, assessment items, dimensions, scoring systems, report structures, report content, models, graphics, training materials, software, methodologies and trade marks are owned by or licensed to flowprofiler® Pty Ltd.
Access to or receipt of a flowprofiler® product does not transfer ownership of the underlying intellectual property.
Assessment content must not be copied, reproduced, reverse engineered, adapted, translated, distributed, used to develop a competing product or entered into an artificial intelligence model without prior written authorisation.
Any permitted use remains subject to the applicable Terms of Use, client agreement, practitioner agreement and product conditions.
Consumer and statutory rights
Nothing in this disclaimer excludes, restricts or modifies:
a consumer guarantee;
a statutory right or remedy;
liability for fraud or fraudulent misrepresentation;
liability for death or personal injury caused by negligence where that liability cannot lawfully be excluded; or
any other responsibility that cannot lawfully be excluded, restricted or modified.
Where liability may lawfully be limited, the applicable limitation will be set out in the relevant Terms of Use, client agreement, practitioner agreement, service agreement or order form.
Applicable documents
This disclaimer should be read together with:
the flowprofiler® Terms of Use;
the Privacy Policy;
the Cookies and Similar Technologies Policy;
the applicable assessment or participant notice;
the relevant client, practitioner or service agreement;
the applicable order form; and
any product-specific guidance or conditions.
Where there is an inconsistency, an applicable signed agreement will take priority to the extent permitted by law.
